THE WILL OF JOHN EGGLETON
DIED 1844
This is the last Will and Testament of me JOHN EGGLETON of Monks Risborough in the County of Buckingham Farmer whereby I direct all my just debts and funeral and testamentary expenses to be paid and satisfied as soon as conveniently may be after my decease I give and bequeath unto my dear Wife ANN All and singular my household furniture plate linen and china and other effects of a like sort for and during the term of her natural life provided she shall so long continue my Widow but not otherwise And I give and bequeath unto my said Wife all and every sum and sums of money due to me from or which I can or may claim of the son of my said Wife Mr JAMES WOOSTER of Illmire Farmer for her own use and benefit Also I give and bequeath unto my said Wife the legacy or sum of One Hundred pounds which I direct shall be paid to her by my son STEPHEN EGGLETON within the space of twelve Months next after my decease out of the share and interest [] to him under and by virtue of this my Will Also I give and bequeath unto my said Wife all that my newly erected Messuage or Tenement wherein I now dwell together with the buildings and out houses thereto belonging And also the Orchard and garden and five acres (more or less) of copyhold land held therewith and also the twelve acres (more or less) of Freehold land called Churchfield and the little Meadow containing about two acres and the little Moor containing about four acres and also my copyhold cottage occupied by WILLIAM REDRUP with their and every of their appurtenances (which said Messuage land and hereditaments are situate and being in the parish of Monks Risborough aforesaid) To hold unto my said Wife for and during the term of her natural life provided she shall so long continue my Widow but not otherwise And from and after the decease or Marriage again of my said Wife whichever shall first happen then I give desire and bequeath unto my said son STEPHEN EGGLETON All that my said newly erected Messuage or Tenement where I now dwell with the buildings and outhouses thereto belonging and the orchard and garden and five acres (more or less) of copyhold land held therewith and also the said twelve acres (more or less) of Freehold land called Churchfield and the said Little Meadow containing about two acres and the said Little Moor containing about four acres and also my said copyhold cottage occupied by WILLIAM REDRUP with their and every of their appurtenances To hold the same with their and every of their appurtenances unto my said Son STEPHEN EGGLETON his heirs and assigns absolutely and for ever Subject nevertheless to the payment of the following legacies or sums which I hereby give and bequeath to the several parties respectively within twelve months next after the decease or Marriage again of my said Wife whichever shall first happen, namely, To my daughter SARAH WOOSTER the sum of Two Hundred and Fifty pounds To my grand daughter JULIA EAST the sum of Forty Pounds To my grand son JOHN EAST the sum of Forty Pounds To my grand son THOMAS EAST the sum of Forty Pounds and to my grand daughter EMMA BIGGS the sum of Fifty Pounds And also subject to the payment of the sum of One Hundred pounds unto and equally between and among all and every the children of my daughter MARY WHITE such sum of One Hundred pounds to be paid within the space of twelve months next after the deaths of my said Wife and my said daughter MARY WHITE And I give and bequeath unto my said son STEPHEN EGGLETON All and singular my Farming Stock implements crops and farming effects whatsoever and wheresoever to and for his own use and benefit absolutely subject nevertheless to the payment by my said son STEPHEN EGGLETON unto my wife of the said sum of One Hundred pounds which sum I have hereinbefore given and bequeathed to her and directed the same to be paid to her within twelve months next after my decease And also subject to the payment of the sum of three shillings and six pence weekly and every week unto my said daughter MARY WHITE during the term of her natural life And I give devise and bequeath unto my son JOSEPH EGGLETON my freehold House Bakehouse Wood house pigsties and garden now in his occupation situate and being at Monks Risborough aforesaid And also my two cottages with the Blacksmiths shop and appurtenances situate at Monks Risborough aforesaid with their appurtenances now in the occupation of RICHARD ELDRIDGE and JOHN DAVENING And also all that my field of arable land situate and being at Innborough otherwise called Romborough in the said parish of Monks Risborough and now in my own occupation To hold the same with their and every of their appurtenances unto my said son JOSEPH EGGLETON his heirs and assigns absolutely and for ever Subject nevertheless to the payment of the following sums to the several parties hereinafter named within twelve months next after my decease which sums I hereby give and bequeath to such parties respectively that is to say the sum of One Hundred and Fifty pounds to my daughter ELIZABETH EAST, the sum of Fifty Pounds to my daughter ANN BIGGS, and the sum of Twenty Pounds to my said daughter MARY WHITE And I hereby direct and declare that the said sum of Twenty Pounds and the said weekly sum of three shillings and six pence so to be paid to my said daughter MARY WHITE as aforesaid shall be free and independent of and not in any manner subject to the debts control or engagements of her present of any future husband and that the receipt of my said daughter MARY WHITE notwithstanding her coverture shall be a good and sufficient discharge for the said sum of Twenty Pounds and the said weekly sum of three shillings and six pence so to be paid to her as aforesaid Provided further and I do hereby order direct and declare that my said Wife shall permit my said son STEPHEN EGGLETON if he shall be willing to do so to rent and occupy at a fair and just rent to be fixed and ascertained by my Executors All and Singular my said Messuages lands tenements and hereditaments so bequeathed to my said Wife for her life aforesaid Except the said Messuage or Tenement wherein I now reside and in case my said Wife shall cease to occupy and reside in the said Messuage or Tenement then shall permit and suffer my said son STEPHEN EGGLETON to rent and occupy such Messuage or Tenement also at a fair and just rent to be fixed and ascertained as aforesaid And I give devise and bequeath (so far as I can and the custom of Manor of Monks Risborough enables me to do) unto my three grand children JULIA EAST JOHN EAST and THOMAS EAST All those my two copyhold Cottages with their appurtenances situate and being at Ascott in the said parish of Monks Risborough and now in the occupation of FRANCIS ELDRIDGE and THOMAS CUMMINGS To hold the same with their and every of their appurtenances unto my said three grand children JULIA EAST JOHN EAST and THOMAS EAST their heirs and assigns for ever as tenants in common and not as joint tenants And I give devise and bequeath unto my daughter ANN BIGGS All those my three freehold Cottages situate and being at Ascott aforesaid together with the orchard garden and appurtenances thereto belonging and now in the occupation of JOSEPH ELSDEN, WIDOW GOODCHILD and WILLIAM BALDWIN To hold unto my said daughter ANN BIGGS her heirs and assigns absolutely and for ever And after the death or Marriage again of my said Wife I direct my Household furniture plate linen and effects of a like sort so given to my said Wife for life or until my Marriage again as aforesaid shall be divided into five equal parts and I give and bequeath one fifth part thereof to each of my daughters ELIZABETH, MARY, SARAH and ANN and the remaining one fifth part or share thereof unto and equally between my three grand children the said JULIA EAST, JOHN EAST and THOMAS EAST And whereas I have already provided for my Sons JOHN EGGLETON, THOMAS EGGLETON, WILLIAM EGGLETON and BENJAMIN EGGLETON I make no further provision for them under this my Will except as hereinafter mentioned And as to all the rest residue and remainder of my real and personal Estate and effects whatsoever and wheresoever not hereinbefore disposed of and now which I shall have a disposing power at the time of my decease I give devise and bequeath the same unto and equally between and among all and every my children share and share alike And I hereby appoint my said sons JOHN EGGLETON and JOSEPH EGGLETON joint Executors of this my Will hereby requesting them to accept the sum of Ten pounds each for their trouble and which I hereby give and bequeath to them accordingly In Witness whereof I the said JOHN EGGLETON the Testator have at the end or foot of this my will contained in Eight sheets of paper set
